Apply, book and bring the signed form
Complete the ServiceOntario online application first. Burlington emails the booking link after submission. Print the application and have both partners sign before the appointment.
One partner may submit the application, but original signatures from both are required. The city allows uploading ID copies during the application. If you bring ID instead, bring original accepted identification for both people. Photocopies presented at the appointment are not accepted. Use ServiceOntario's linked list of acceptable identification.
Previous marriage and translated documents
For a Canadian divorce, the city asks for an original certified Decree Absolute or Certificate of Divorce from the court. The page has conflicting language about other divorce orders, so confirm the exact acceptable document with staff rather than assuming a judgment is sufficient.
A divorce outside Canada needs additional Registrar General authorization. The source lists a signed licence application, sealed certified divorce or annulment document, a Sole Responsibility statement and an Ontario lawyer's legal opinion. A certified translation is needed for documents in another language. This is an extra approval route, not something the counter can waive.
Younger and widowed applicants
Applicants age 16 or 17 need the required parental or guardian consent, with exceptions for widowed or divorced applicants. If consent is refused, the city directs applicants to the court process. A widowed applicant does not need a death certificate for this licence application.
A licence gives legal authority to marry. It does not book an officiant or ceremony and is different from the marriage certificate requested after the wedding.
Questions and answers
Can I get a licence as a walk-in?
No. Burlington requires an appointment after the online application.
Must both partners attend?
At least one must attend. Both must provide original signatures on the printed application.
Can the wedding be outside Burlington?
Yes. The licence is valid anywhere in Ontario.
How long is the licence valid?
Three months from issue. Plan the appointment around the wedding date.
What does the city charge?
The source lists $175.10, paid at processing by credit or debit.
Can I pay by cheque?
No. The city excludes cheques for this service.
Can I bring photocopied ID?
Not as appointment identification. If bringing ID rather than uploading it, bring the required originals for both partners.
Does a widowed applicant need a death certificate?
The city says no for a marriage licence.
Can someone under 16 apply?
No. The Ontario minimum stated by the city is 16, with consent requirements for 16- and 17-year-olds.
What if a divorce happened abroad?
Use the Registrar General authorization process and obtain the required Ontario legal opinion. Do not assume a foreign decree alone is enough.
